The ButterCup Cake website may have/have links to other websites over which ButterCup Cakes has no control. No liability is accepted by ButterCup Cakes in respect of the operation or content of such websites. The creation of links to the ButterCup website is not permitted without permission from ButterCup Cakes.
You may not use the ButterCup Cakes website for any of the following purposes:
Breaching any laws concerning the use of public telecommunications networks.
Making, transmitting or storing electronic copies of materials protected by copyright without the permission of the owner.
Interfering with any other person's use or enjoyment of the ButterCup Cakes website
Disseminating any material which is harassing, abusive, unlawful, libellous, harmful, vulgar, obscene, threatening or otherwise objectionable.
Transmitting material that encourages conduct that constitutes a criminal offence, results in civil liability or otherwise breaches any relevant laws, regulations or code of practice.
Interfering with or disrupting networks or web sites connected to the ButterCup Cakes website.
Gaining unauthorised access to other computer systems.
ButterCup Cakes website reserves the right to refuse to post material on the ButterCup Cakes website or to remove material already posted on the ButterCup Cakes website.
You will indemnify us against all losses, liabilities, costs and expenses reasonably suffered or incurred by us, all damages awarded against us under any judgment by a court of competent jurisdiction and all settlements sums paid by us as a result of any settlement agreed by us arising out or in connection with:
Any fines or penalties imposed by any regulatory, advertising or trading body or authority in connection with your use of the ButterCup Cakes website by you; any claim by any third party that your use of the ButterCup Cakes website is in breach of any applicable law, regulation or code of practice, or that your use of the website is defamatory, abusive, offensive or obscene; and any claim by any third party that your use of the ButterCup Cakes website infringes that third party's copyright or other intellectual property rights.
The ButterCup cakes Website shall be governed by English law. The English courts shall have exclusive jurisdiction over any disputes arising from these sites.
ButterCup cakes will not be liable for any breach of these Terms and Conditions where that breach is due to circumstances beyond its control.
Please use the online booking system in the online shop area of this site. Any place/places are not secured on one of our classes until a full payment has been made and you have received a confirmation by email from ButterCup Cakes. You will receive a separate email from PayPal but this is not a confirmation of a class place so do not make any arrangements purely relying on this email.
You will be sent all the details of the class by email including location etc.
Course Content or Details
You will be shown and taught many different techniques and designs during the classes. All these designs and the techniques for making the designs on the cakes that you are shown and taught belong to Linda Ashcroft from ButterCup Cakes. By purchasing a class place, you are free to copy all of these designs for the purpose of your own cake making, excluding commercial use.
Once a class has been booked and it has been paid for it, we are not able to offer any refunds for any reason if you cannot attend. We will allow you to find someone else to take your place on the course and date you have booked. You must notify us by email providing their full name, email address and contact number.
If ButterCup Cakes had to cancel a class for any reason, then we will offer an alternative date(s) to you. If we cannot offer you an alternative date we will provide you with a full refund of the cost of your class.
If a class is cancelled by us due to bad weather, we will do our best to reschedule your class place to another date in the future.
ButterCup Cakes sells Gift Vouchers which can be redeemed against the price of a Cake Decorating Class or used in the Online Shop.
Gift Vouchers cannot be exchanged for money so you need to use the full value of your voucher when purchasing a Cake Decorating Class or from our online shop.
A Gift Voucher recipient can only make a purchase over the phone or in person. Full details of how to do this are included with the Gift Voucher.
ButterCup Cakes will never disclose any personal details you have supplied to any third parties unless agreed by yourself. No personal details you supply will ever be used on our website unless agreed by yourself.
All bookings are subject to the laws and jurisdiction of England and Wales.
ButterCup Cakes shall not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these terms and conditions that is caused by events outside our reasonable control (“Force Majeure Event”).
If a class is cancelled due to a Force Majeure Event we will reschedule the class to another date. No refunds will be given in the case of a Force Majeure Event unless agreed by ButterCup Cakes.
Wedding Cakes and Celebration Cakes – Force Majeure Event
Once payment has been paid, a contract will be non-cancellable by the customer. Ordering mistakes by customers with regard to class dates, weddings or other events will not constitute grounds of cancellation. Notwithstanding the above, acceptance of cancellation by ButterCup Cakes in exceptional circumstances and any refund or part refund will be solely at the discretion of ButterCup Cakes.
In any event the maximum liability of ButterCup Cakes will be not more that the purchase price of the products and/or services (which includes classes, wedding cakes and celebration cakes) under the contract, should the contract be cancelled for any reason.
All edibles which include: Sugarpaste, Glitters, Modelling Paste, Cake Toppers and Cake Decorations are excluded due to hygiene reasons.
You can send your return by post or courier. Please ensure you include your name, address, email address and contact telephone number.

The return of items is at your own cost. You should always obtain a certificate of postage from the Post Office as we can only be responsible for your items once they have received at the above address. Any items lost in transit cannot be treated as returned.
